This position focuses on providing legal advice for advertising and marketing activities across all platforms, with an emphasis on reviewing marketing collateral such as PoP, print, digital, social, experiential and press releases. Other areas of responsibility include promotions, rebates, sweepstakes, and contests. Further responsibilities include negotiating and drafting contracts related to promotional, advertising/agency, and event agreements. This role will involve offering guidance on legal issues related to social media and FTC regulations, claim substantiation, and managing advertising disputes. The role will report to the SVP, General Counsel. Role and Responsibilities Provide fast turnaround guidance, review and approvals on various marketing materials such as PoP, print, digital, social, experiential and press releases. Provide timely guidance on, draft, review, and/or approve promotions, rebates, sweepstakes, and contests. Advise on, draft, and negotiate various advertising and marketing agreements, including agency agreements (e.g., MSAs and SOWs), as well as other marketing, promotional, event, and creative/consulting agreements. Provide daily real-time guidance on legal issues related to social media, FTC regulations, and the Samsung website/eCommerce. Regularly meet with relevant marketers to assess risk and provide solutions to proposed promotional activities. On an as-needed basis, collaborate with marketers and North American HQ (including Digital) on contract matters and conduct periodic agency agreement audits to ensure compliance with standards. Regularly/daily meet with all marketing teams to review, edit, and approve consumer-facing materials. Monitor and review issues that may arise in digital and social media spaces. Stay updated on FTC and relevant legal cases, reporting findings to Legal and clients, including providing necessary training. Advise and inform the SEA legal team of US compliance with all relevant and current US legal issues in global product and marketing campaign launches.
Skills and Qualifications
Minimum of 15 years of legal experience, preferably including training at a nationally recognized or relevant boutique law firm and/or in-house experience. Prior experience counseling on advertising/marketing issues, with expertise in promotions, rebates, social media, online marketing, sweepstakes, and contests. Experience drafting and negotiating related agreements is required. Familiarity with FTC/NAD is a plus. Admitted to the Bar of at least one state and eligible for admission to the Texas bar as in-house counsel.
