Role and Responsibilities The Director of Employment Law will be instrumental in leading the Employment Law Function at Samsung Electronics America (SEA) and North America Headquarters (NAHQ) divisions on areas of employment and labor law compliance, including equal opportunity laws, leave and accommodation laws, wage and hour laws, pay equity, labor law, benefits law, and internal policy development and training. This position will handle supervising and directing employment law compliance and risk management through management of and adherence to policies and employment laws. This role serves as the key advisor to the People Team, advising on and partnering to develop strategy for employment law compliance and risk/reputation management. This role will be based in Plano, TX, and may require travel to other Samsung offices in North America. Primary areas of responsibility include Management of Employment law function, investigations including responding to and mediating agency matters e.g., EEOC, State divisions of civil rights, Department of Labor. Investigate, respond to and negotiate pre-litigation claims. Development and Delivery of Training Programs for HR Clients Within SEA, Affiliates and Business. Lead the development, improvement and implementation of policies and processes including termination reviews, reasonable accommodations, leave management Review and update employee handbook and policies for SEA and subsidiaries/affiliates. Lead the Employment Practices team, setting priorities, processes, policy documents and trainings Handle threatened litigation and negotiation with opposing counsel and agency administrative charges of discrimination. Managing claims process and policy management for Employment Practices Liability Insurance (EPLI) coverage. Review and revise executive offer letters, agreements and incentive plans. Oversee investigations of employee complaints and review/revise commercial contracts to address employment law matters. Advising on NA Risk Management Audits, reviewing and guiding on audit results. Provide counseling to Human Resources and subsidiaries/affiliates on employee performance improvement, discipline and terminations. Provide counseling regarding wage and hour exemptions, pay equity laws and reviews and compliance with FLSA and comparable state and local laws. Provide counseling regarding employee accommodations, obligations under disability laws, FMLA compliance, leaves of absence and paid sick leave. Provide counseling on employment law issues and reporting obligations for purposes of compliance and audit. Prepare and conduct training for Human Resources and other internal clients on employment law trends and issues and best practices for mitigating legal risk.
Skills and Qualifications
Qualifications Juris Doctorate degree from accredited US Law School with 10-15 years of experience. Member in good standing of one US state bar, and ability to become member in good standing of TX bar or qualify as in-house counsel in TX. Must have excellent written and verbal communication skills. Experience appearing before state and federal agencies on employment matters. Experience
